Hypodash Terms of Service

1. Terms

By accessing or using the Hypodash service at https://hypodash.com (including the web application, APIs, automations, and related services), you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the service.

2. Description of Service

Hypodash is an AI-powered article generation and automation platform. The service enables you to:

  1. Generate written articles and related content using third-party AI models (currently via the OpenAI API);
  2. Generate image media to accompany articles (also via the OpenAI API or other supported providers from time to time);
  3. Configure automations that send completed articles and related data to destinations you control, including webhook endpoints and integrations such as Zapier triggers.

You are responsible for how you configure and use Hypodash, including which prompts, data, and destinations you supply.

3. Use of Service & Licence

  1. Hypodash grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the service for your own internal business or personal purposes, subject to these Terms.
  2. Under this licence you may not:
    1. copy, modify, or create derivative works of the service (except for content you generate using the service, which you may use in accordance with applicable law and any third-party rights);
    2. attempt to decompile, reverse engineer, or otherwise access the source code or underlying models of the service where not expressly permitted;
    3. bypass or circumvent any access controls, rate limits, or security measures;
    4. remove or alter any proprietary notices or branding; or
    5. resell, sublicense, or otherwise make the service available to third parties on a standalone basis.
  3. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Hypodash at any time in accordance with these Terms.

4. AI Article Generation, OpenAI & Your API Key

  1. Use of your personal OpenAI API key: Hypodash uses the OpenAI API (and may support other AI providers in future) to generate articles and image media. You provide your own personal OpenAI API key, which is used solely to perform requests on your behalf.
  2. Separate billing relationship with OpenAI: Your relationship with OpenAI (including all usage fees and billing) is separate from your subscription to Hypodash. You are solely responsible for all costs, charges, and fees incurred with OpenAI (or any other AI provider you choose to integrate), even when requests are initiated via Hypodash.
  3. Hypodash subscription scope: Your Hypodash subscription fee covers access to the Hypodash platform and its generation and automation features only. It does not include or cover any OpenAI usage fees or other third-party provider costs.
  4. Token usage information: After generation, Hypodash may display token usage or similar metrics for your convenience. These values are provided on an informational basis only and may not perfectly match OpenAI’s own accounting. You acknowledge that:
    • Accurate usage and billing information is available only via OpenAI’s own dashboard, APIs, or billing statements; and
    • You are responsible for monitoring your own usage and associated costs directly with OpenAI.
  5. Data sent to OpenAI: Prompts, article content, image requests, and any other data you submit via Hypodash for generation are transmitted to and processed by OpenAI in order to provide the requested outputs. Such data is handled by OpenAI in accordance with its own terms, policies, and retention practices, which Hypodash does not control. You are responsible for reviewing and understanding OpenAI’s terms and policies, available at https://openai.com/policies.
  6. Lawful and responsible use: You are solely responsible for ensuring that your use of Hypodash and OpenAI (including the data you submit and the content you generate) complies with all applicable laws, regulations, and third-party rights, as well as OpenAI’s usage policies.

5. Media Storage & Deletion

  1. Image media retention: Image media generated via Hypodash (for example, featured images or article images) may be temporarily stored by Hypodash to enable delivery, preview, and automation.
  2. Deletion timeframe: Hypodash deletes generated media images from its systems within 48 hours after creation, subject to reasonable backups and logs retained for security, audit, or legal purposes.
  3. Your responsibility for copies: You are responsible for ensuring that any images or other outputs you wish to retain are stored in your own systems or destinations (for example, via your CMS, storage provider, or webhook integration). Hypodash does not guarantee long-term storage or availability of generated media beyond the above retention window.

6. Automation, Webhooks & Third-Party Integrations

  1. Webhooks and destinations you control: Hypodash allows you to configure webhook endpoints and integrations (including, but not limited to, Zapier triggers) so that generated articles and related data can be automatically sent to systems you control.
  2. Your responsibility for configuration: You are solely responsible for:
    • The endpoints, integrations, and third-party services you connect to Hypodash;
    • The security, authentication, and correctness of any webhook URLs or API keys you provide; and
    • Ensuring that your use of such integrations complies with all applicable terms of those third parties.
  3. No responsibility for third-party services: Hypodash is not responsible for any failures, downtime, data loss, misconfiguration, or other issues arising from third-party services, including webhook recipients, Zapier, or any other tools you connect to Hypodash.

7. User Content & Responsibility

  1. You retain responsibility for the prompts, source material, and configuration you provide to Hypodash, and for any articles, images, or other outputs you choose to publish, distribute, or otherwise use.
  2. You are responsible for reviewing generated content before use and ensuring that it is accurate, lawful, appropriate for your intended audience, and compliant with any industry-specific requirements that apply to you.
  3. Hypodash does not provide legal, financial, or professional advice and does not guarantee that generated content will be free from errors, infringement, or other issues.

8. Disclaimer

  1. The Hypodash service and all materials made available through it are provided on an "as is" and "as available" basis. Hypodash makes no warranties, express or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property, or other violation of rights.
  2. Hypodash does not warrant or make any representations concerning the accuracy, reliability, or suitability of any generated content or the results of using the service, or otherwise relating to such materials or on any sites linked to or integrated with the service.

9. Limitations of Liability

In no event shall Hypodash, its owners, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of data, loss of content, loss of profits, loss of business opportunities, or business interruption) arising out of or in connection with your use of, or inability to use, the service or any generated content, even if Hypodash or an authorised representative has been notified orally or in writing of the possibility of such damage. To the maximum extent permitted by law, Hypodash’s total aggregate liability arising out of or relating to the service shall be limited to the amounts you have paid to Hypodash for the service during the three (3) months immediately preceding the event giving rise to the claim.

10. Accuracy of Materials

The materials and information appearing on Hypodash’s website or within the service could include technical, typographical, or photographic errors. Hypodash does not warrant that any of the materials on its website or in the service are accurate, complete, or current. Hypodash may make changes to the materials contained on its website or in the service at any time without notice, but does not make any commitment to update such materials.

11. Links

Hypodash has not necessarily reviewed all of the sites or services linked to or integrated with the service and is not responsible for the contents of any such linked site or third-party service. The inclusion of any link or integration does not imply endorsement by Hypodash. Use of any such linked website or third-party service is at the user’s own risk.

12. Modifications to the Service

Hypodash is continuously evolving and improving the service. We reserve the right, at our sole discretion, to add, modify, suspend, or remove features or functionalities of the platform at any time, with or without prior notice, provided that we will use reasonable efforts to avoid materially degrading the overall core functionality of the service for active subscribers.

Your continued use of Hypodash following any such changes constitutes your acceptance of the modified service. If you do not agree with any changes, your sole remedy is to discontinue use of Hypodash in accordance with these Terms.

13. Changes to These Terms

Hypodash may revise these Terms of Service at any time. When we make material changes, we will take reasonable steps to notify you (for example, via the app or by email). By continuing to use the service after changes become effective, you agree to be bound by the then-current version of these Terms.

14. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom, and you irrevocably submit to the exclusive jurisdiction of the courts of the United Kingdom in relation to any dispute arising out of or in connection with these Terms or the service.

15. Abuse and DMCA

If you would like to report any copyright or potentially illegal content generated via Hypodash or published using our automations, please email [email protected] with sufficient detail for us to investigate (including relevant URLs, screenshots, and a description of your concern).

16. Email Opt-Out & Reporting

If you would like to report issues with email communications from Hypodash or to opt out of certain types of email (where permitted by law), please follow the unsubscribe instructions contained in our emails or contact us at [email protected].

17. Payment & Subscriptions

  1. Subscriptions to Hypodash are processed securely through Stripe or other payment processors we may use from time to time.
  2. A valid subscription grants you access to the Hypodash service for the applicable subscription period. After the subscription period, continued access requires renewal of the subscription.
  3. Your Hypodash subscription covers access to the Hypodash platform and its generation and automation features only. All OpenAI usage fees (and any other third-party provider fees) are separate and billed directly by those providers.
  4. If you choose to cancel your subscription, your access to Hypodash and its features will end once the current subscription term expires, subject to any applicable grace periods.
  5. Hypodash reserves the right to terminate or suspend access to its services at any time, for any reason, with a minimum of 30 days’ notice provided to active subscribers, except where immediate suspension is required for legal, security, or abuse-related reasons.

18. Subscription Cancellation & Refunds

  1. You can cancel your subscription at any time from your billing settings or by contacting our support team at [email protected].
  2. All subscription fees are non-refundable, except where required by applicable law. Cancellation will stop future renewal charges, and you will retain access to paid features until the end of your current subscription term.
  3. In certain cases, Hypodash may, at its sole discretion, provide a refund or credit on a case-by-case basis. Users seeking such consideration should contact [email protected] with relevant details of their request.

19. Acceptable Use & Data Quality

You agree that you will not use Hypodash to upload, transmit, store, generate, or otherwise process any data or content that is unlawful, harmful, fraudulent, defamatory, infringing, hateful, harassing, misleading, or otherwise objectionable, including but not limited to:

  • Content that violates any applicable law, regulation, or third-party rights (including privacy, intellectual property, and confidentiality rights);
  • Unsolicited or unauthorized marketing communications or spam;
  • Malicious code, viruses, or content intended to disrupt or damage systems, data, or networks;
  • Content that violates the applicable usage policies of OpenAI or any other third-party provider you use with Hypodash.

You are solely responsible for the accuracy, quality, and legality of the data and prompts you provide to Hypodash, and for obtaining all necessary consents and authorisations to process such data (including any personal data) through Hypodash and OpenAI.

Hypodash reserves the right, in its sole discretion, to suspend or terminate your access to the service, in whole or in part, if we believe that your use of the service (or the data or content you provide) violates these Terms, applicable law, or presents a risk of harm to Hypodash, our infrastructure, other customers, or third parties.
